These Terms of Service ("Terms") govern your access to and use of the VIRALSIG service (the "Service"), operated by Elegant Solar Inc ("VIRALSIG," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service
VIRALSIG helps creators generate, manage, and publish short-form video clips from their long-form content, and publish those clips to the creator's own connected platform accounts (TikTok, YouTube Shorts, Instagram Reels, and X) via each platform's official APIs, including the TikTok Content Posting API. You authorize VIRALSIG to perform these actions on your behalf through the permissions you grant.
2. Eligibility & Accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
3. Account Connection & Authorization
To publish content, you connect and authorize a platform account (for example, TikTok via Login Kit). You represent that you are the authorized holder of any account you connect, and that you have the right to grant the permissions requested. You may revoke authorization at any time through your platform settings or by disconnecting within the Service.
4. Your Content & Responsibility
You retain ownership of the content you provide and publish through the Service. You are solely responsible for your content and for ensuring you have all necessary rights to it. You agree to use the Service only for content you own or are authorized to use and publish.
5. Acceptable Use
You agree not to use the Service to:
- Violate any law or the terms, policies, or Community Guidelines of any connected platform, including TikTok's Terms of Service and Community Guidelines.
- Infringe the intellectual property, privacy, or other rights of any third party.
- Publish unlawful, harmful, deceptive, or abusive content.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its systems.
6. Content Removal & Revocation
You may disconnect your account and revoke VIRALSIG's access at any time. We may suspend or remove content, or suspend or terminate access, if we reasonably believe these Terms or a connected platform's policies have been violated.
7. Intellectual Property
The Service, including its software, design, and branding, is owned by Elegant Solar Inc and protected by applicable laws. These Terms do not grant you any right to our trademarks or branding except as needed to use the Service.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any particular result (such as reach or engagement) will be achieved.
9. Limitation of Liability
To the maximum extent permitted by law, Elegant Solar Inc will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us, if any, in the twelve months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless Elegant Solar Inc from any claims, damages, liabilities, and expenses arising out of your content, your use of the Service, or your violation of these Terms or applicable law.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or its users. Provisions that by their nature should survive termination will survive.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in Arizona for any dispute arising out of or relating to these Terms or the Service.
13. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and revise the "Last updated" date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
